Experience/Practice Areas

Sean is first and foremost a trial lawyer. He has served as lead lawyer in more than 50 jury trials, participated in countless others, and handled scores of non-jury trials and arbitrations. He has tried cases and handled motions in the South Carolina state and federal courts, the Delaware federal court, and bankruptcy courts throughout the nation. He has argued in the South Carolina Supreme Court and Court of Appeals more than a dozen times and has written numerous briefs in the Fourth, Fifth, Sixth and Eighth Circuit Courts of Appeals, plus a petition for certiorari to the U.S. Supreme Court.

Sean’s litigation experience enables him to help clients avoid future disputes and to negotiate the best possible result without a trial, when that is in the client’s best interest. He thus provides a full range of services to his clients.

Insurance Coverage Litigation Sean has handled numerous bad faith and coverage lawsuits against insurers such as Allstate, State Farm and Nationwide. He argued the winning side, in favor of coverage, in one of South Carolina’s most significant coverage opinions, L-J, Inc. v. Bituminous Fire and Marine Ins. Co., 350 S.C. 549, 567 S.E.2d 489 (Ct. App. 2002) (subsequently reversed after Sean left his firm).

Sean also formerly served with another lawyer as national counsel coordinating the defense for an insurer which wrote commercial policies for some of the nation’s largest manufacturers and then found itself embroiled in coverage issues arising out of the mass tort maelstrom. Again, that experience on behalf of an insurer serves him well in representing people and businesses which have been denied coverage.

Appellate Practice Sean has argued in the South Carolina Supreme Court and Court of Appeals more than a dozen times and has written numerous briefs in the Fourth, Fifth, Sixth and Eighth Circuit Courts of Appeals, plus a recent petition for certiorari to the U.S. Supreme Court.

Construction Litigation Sean represents and has represented numerous homeowners and businesses whose structures suffer from defective construction, including EIFS (synthetic stucco) and other water intrusion issues. These cases often involve mold exposure and other “sick building” claims. Sean has experience defending suppliers, subcontractors, architects, a major commercial contractor, and construction managers. His experience handling the insurance coverage aspect of defective construction claims is a valuable asset in bringing construction cases.

Commercial, Business and Contractual Disputes Sean serves as counsel to several local businesses, large and small. He handles contractual issues, business organization issues, tortious interference claims, unfair trade practices claims and business fraud and unfair competition claims on behalf of his clients. Sean’s litigation experience has given him the insight necessary to effectively negotiate and interpret contracts for his clients in an effort to avoid disputes as well as to prevail in them.

Real Property, Condemnation and Landlord/Tenant Litigation Sean has handled numerous trials involving real property issues, including contract/purchase disputes, easements, trespass, and boundary and title disputes. He has represented entities whose property was being taken by the government. He continues to represent numerous landlords in the tri-county area and serves as counsel to the Charleston Apartment Association.

Serious Personal Injury Litigation Sean has handled wrongful death, brain injury, slip and fall, auto accident, premises liability and several other varieties of personal injury lawsuits.

For several years, he defended insurance companies, commercial businesses and a local hospital in injury cases and that experience gives him valuable insight when representing injury plaintiffs.

Arbitration With the growing popularity of alternative dispute resolution, Sean’s experience in arbitration comes into play more and more often. He has handled arbitrations large and small in South Carolina and New York City.
